LEGISLATION TEMPLATE FOR CAPITAL PROJECTS

 Section ________  Capital Projects; Certified Professional Estimator required.

A.     For the purpose of this section:

(1)     “Certified Professional Estimator” means a cost estimator, cost engineer or cost consultant certified by the American Society of Professional Estimators or the American Association of Cost Engineers or having equivalent experiences, certification or registration; and

(2)     “Capital Project” means construction or renovation for those projects appropriated to the capital program fund as defined in Section _________ .

B.     The general services department may contract with a Certified Professional Estimator to provide cost estimating services for capital projects under __________ dollars and shall contract for such services on any projects over ____________ dollars unless the department determines that cost estimating services are not necessary. The Certified Professional Estimator shall provide cost estimating services for the capital project from the planning stage through the end of construction, and the department may contract with the same Certified Professional Estimator for all capital projects approved by the legislature during any one year.

C.     Within twenty days after the end of a legislative session in which capital projects have been authorized by the legislature, the department shall advertise for requests for proposals from qualified persons for cost estimating services for capital projects approved by the legislature during that session. The department shall review the proposals and submit three proposals to the State Architects Office for selection. The State Architects Office, after consultation with the legislative finance committee, shall select the Certified Professional Estimator.

D.     No capital project shall proceed, and no money transferred, until the department has contracted with a Certified Professional Estimator to provide cost estimating services for the approved capital projects.

E.      The Certified Professional Estimator shall keep the secretary of general services and the property control division informed of the progress of the capital projects under the Certified Professional Estimator’s control. The secretary and the Certified Professional Estimator shall make periodic reports to the legislative finance committee.

F.      For capital projects not under the control of the general services department, the legislature may require, or the controlling agency may request, the assistance of the Certified Professional Estimator on those projects.
